Third-Party API & Risk Disclaimer READ CAREFULLY: The Service functions using a proprietary third-party API integration and is not affiliated with, endorsed by, or an official product of WhatsApp Inc. or Meta Platforms, Inc. Risk of Ban: WhatsApp’s policies regarding automated tools are strict. By using 2ndu, you acknowledge that there is an inherent risk that your WhatsApp account may be restricted, suspended, or permanently banned by WhatsApp for automation activity. Liability Waiver: You agree to use the Service entirely at your own risk. Creatiq AI Solutions shall not be held liable for any account bans, loss of access, or data loss resulting from the use of 2ndu. 3. Data Privacy To function, the Service processes specific data: Collected Data: Your WhatsApp phone number, message content sent to the bot, and profile name. Usage: Data is used solely to execute your commands and improve response accuracy. Storage: Conversation logs may be temporarily cached on our servers for context handling. No Third-Party Sharing: We do not sell or share your personal chat data with third parties. 4. User Conduct You agree NOT to use 2ndu for: Sending unsolicited bulk messages (Spam). Harassing, defaming, or threatening individuals. Distributing illegal content or infringing on intellectual property. Attempting to reverse-engineer or disrupt the Service's infrastructure. Violation: Creatiq AI Solutions reserves the right to block access to the Service immediately and without notice for any user violating these terms. 5. Availability ("As Is") The Service is provided on an "As Is" and "As Available" basis. We do not guarantee 100% uptime. Service may be interrupted due to server maintenance, network issues, or changes to the WhatsApp protocol by Meta. 6. Limitation of Liability To the fullest extent permitted by law, Creatiq AI Solutions shall not be liable for any direct, indirect, incidental, or consequential damages (including loss of profits or business reputation) arising out of the use or inability to use the Service. 7. Governing Law These Terms shall be governed by and construed in accordance with the laws of Malaysia.
